Copyright Violator From China

Since we released our first video in 2013 I have found a number of YouTube accounts that have used our footage and even uploaded our entire videos with the purpose of monetizing with them, therefore filing copyright infringement reports is something I do on a frequent basis. This afternoon, however, I received an email from YouTube saying that one of the violators filed a counterclaim indicating that he shot one of our videos:

Counter-Notification as follows: Videos included in counter-notification: http://www.youtube.com/watch?v=B-BZxeCZbew

Display name of uploader: Video Film Files

The video is owned by us ; we took the video and posted in our youtube channal and website ; we claim all the rights of the machine . please restore our video I swear, under penalty of perjury, that I have a good faith belief the material was removed due to a mistake or misidentification of the material to be removed or disabled. I consent to the jurisdiction of the Federal District Court for the district in which my address is located, or if my address is outside of the United States, the judicial district in which YouTube is located, and will accept service of process from the claimant.

  1. I cannot believe that this guy is even trying this.
There is no way he can substantiate his claim.
These people should be dealt with as harshly as the law allows.
I wish you strength and courage to deal with this and although i can only offer my moral support I do this completely.

  2. Well, this is a particular case. Usually copyright violators download the entire video, upload it using their accounts and start monetizing but this guy is telling YouTube that he shot my video.

    Thanks for your support, David!

  3. Hi

We had the exact same thing happen to us by these guys and got the exact same letter, on the exact same day, with the exact same text as you.

I just sent you an email.

  4. Yes Dennis, I got your email. I think this is a new kind of procedure that crooks are using. Hopefully YouTube will find a way to weed out those false claims. Thanks!

  5. We have reached out to about a half dozen other creators that had their content stolen from these guys. We are hunting down even more. Hopeful if we can get them to file claims YouTube will be forced to shutdown that account. Bad news is we found at least 5 other YouTube accounts by this guy.

    I’ll keep you posted.

  6. Who knows how many other accounts he is using but even if YouTube cancels all of them he will probably create more accounts using different email addresses to do the same copyright infringement.

Thank you for keeping me posted on this!

  7. The only thing I know is that the guy was trying to monetize on videos made by other people but apparently there were many complaints about his YouTube account.

  8. Yes Dennis, his account has been reinstated, however our video was removed from the list of clips he has stolen.

Thanks for keeping in touch regarding this case.
